Restaurants and food service businesses in India must issue a GST bill for every customer transaction above ₹200. The bill must show a clear breakup of food charges, GST amount, and total. The GST rate for restaurants depends on the type — standalone restaurants (AC or non-AC) pay 5% GST but cannot claim Input Tax Credit, while restaurants in 5-star hotels pay 18% GST with ITC benefit.
Since January 2020, the GST Council removed the distinction between AC and non-AC restaurants — both now pay 5% GST. Only restaurants located inside 5-star rated hotels with room tariff above ₹7,500 per night attract 18% GST.
Restaurants opting for 5% GST cannot claim Input Tax Credit on inputs like raw materials, furniture, or kitchen equipment. This means the 5% GST collected goes entirely to the government. To claim ITC, a restaurant must charge 18% GST (only applicable in 5-star hotels).
